Judge Failla, in a similar case to Nessa Risle's lawsuit against Uniswap, used a self-driving car analogy, seemingly showing more sympathy for the developers behind Uniswap and a harsher stance towards Tornado Cash. According to materials shared by Terrett, the judge argued that holding software developers liable for the misuse of neutral infrastructure by strangers would be illogical. He considered Uniswap as "neutral infrastructure," while Tornado Cash was deemed to have "participated in illicit financial activities" (knowingly continuing to operate it for money laundering). This statement suggests that US courts may consider whether developers merely provided neutral tools, rather than engaging in illegal activities, when determining liability for decentralized finance (DeFi) infrastructure in the future.
