一、基本案情
小文是一名币圈的OTC商，长期在BN、OK、HB等平台从事虚拟货币承兑买卖业务。2022年的某一天，突然被公安机关上门带走，并以“开设赌场罪”为由进行拘留。37天后因检察院不批捕取保候审。
取保候审期间，经公安机关查实，小文长期帮助某网赌平台代表王某通过虚拟货币交易的方式，洗白了上亿的赌资。但小文并不知道王某的真实身份，只认为王某是个难得的稳定的大客户。
最终，历经一年后，本案因证据不足，小文无罪释放。
二、站在公安视角，你会轻易放过小文吗？
首先，由于我国《刑法》《刑事诉讼法》等没有确认犯罪嫌疑人的具体规定，因此在刑事案件立案后，只要是可能实施犯罪的都可以被侦查机关认定为犯罪嫌疑人。
其次，根据《刑事诉讼法》第八十二条和《公安机关办理刑事案件程序规定》第一百二十四条的规定：“公安机关对于现行犯或者重大嫌疑分子，有下列情形之一的，可以先行拘留：（二）被害人或者在场亲眼看见的人指认他犯罪的；（三）在身边或者住处发现有犯罪证据的；（五）有毁灭、伪造证据或者串供可能的。”
重点来了，币圈案件中，银行流水等交易记录就是最好的涉案证据，在有这种直接证据或多个间接证据的情况下，很容易套到第2、3种情况，为了查明案件事实，公安机关认为属于重大嫌疑分子，先拘留了没毛病吧？如果本来就有证据，且全案有人在逃，公安机关为了防止毁灭、伪造证据或者串供，先行拘留没毛病吧？
最后，小文确实和王某进行了长期且大量的虚拟货币交易；公安机关问小文为什么不和王某确认资金来源？小文回答“问过了，客户只说了肯定合法。”公安机关问小文银行卡多次被多地冻结就没有怀疑过王某有问题？小文回答“也不好一直问，显得不尊重，怕问多了客户跑了。”公安机关问小文虚拟货币交易属于非法金融活动知不知道，小文回答“知道违法，但不知道犯罪。”
如果你是公安机关，你在客观证据充分，仅仅缺少小文主观明知的证据的情况下，你会不会先拘留？我们这里先不要杠变更强制措施（取保候审）的问题，至少公安机关先行拘留的权限真的很大。
三、案件小结：币圈合规是个伪命题
本案罪名历经了开设赌场、帮信、掩饰隐瞒犯罪所得、非法经营等多个罪名的变更，不过在经过了漫长且复杂的和公检法的沟通后，小文最终还是无罪释放了，无罪的核心其实就是公安机关最终也无法查到小文存在主观明知的证据，无法证明主观故意，就无法构成开设赌场、帮信、掩饰隐瞒犯罪所得等罪名，而非法经营罪的话又没有明确的国家规定。
不得不说，小文是幸运的，因为和小文一样的人，也有很多办案机关在证据不足的情况下还是被强行判决了，这里面不乏一些大的OTC商、项目方，甚至是知名交易所的负责人。很多币圈的人经常问郭律师怎么做能合规，郭律师都劝他们换个行当，因为在法律规定缺乏的当下，在所有虚拟货币业务活动都被认定为非法金融活动的当下，币圈合规根本就是一个伪命题。就算小心再小心，注意到了很多潜在的合规风险，准备了足够的证据，你就能绝对的避免遇到像小文一样的遭遇吗？要知道，法律也只是社会的一面，很多法律之外客观因素更是难以预防的。
法律是滞后的，一个新的行业需要不断的有人“以身试法”，才会不断的完善，也才能逐渐的合规。
