According to Cointelegraph, U.S. prosecutors have appealed the sentencing of Sergei Potapenko and Ivan Turõgin, co-founders of the crypto mining service HashFlare, who were involved in a $577 million Ponzi scheme. The appeal was filed in a Seattle federal court, challenging the sentences handed down earlier this month. Potapenko and Turõgin, who were extradited from Estonia to the United States in May 2024, had pleaded guilty to conspiracy to commit wire fraud. They had been in custody for 16 months in Estonia following their arrest in October 2022. The government had initially sought a 10-year prison sentence, citing the significant harm caused to victims and labeling the scheme as one of the most substantial fraud cases the court had encountered. However, the court sentenced them to time served, imposed a $25,000 fine, and mandated 360 hours of community service, which they are expected to complete in Estonia. Prosecutors argue that the lenient sentence fails to reflect the severity of the crime, which involved misleading investors with false dashboards that exaggerated HashFlare's mining capacity and returns. The scheme operated as a classic Ponzi scheme, where payouts to existing members were funded by new investors. Despite the overstated mining capacity, Potapenko and Turõgin's defense claimed that customers received cryptocurrency worth more than their initial investments due to the rise in crypto market prices. They also asserted that victims would be fully compensated from over $400 million in assets forfeited as part of a plea deal. However, prosecutors have challenged these claims, suggesting that the data was fabricated. The case has highlighted concerns within the blockchain community about the lack of significant consequences for crypto crimes. Investigators and experts have pointed out that the perceived leniency in enforcement actions against bad actors is contributing to the rise in crypto-related crimes. In the first half of 2025, crypto crime losses reached a new record, surpassing previous years.
